Privacy Statement Soma Works B.v.

Soma Works is located in Maastricht. Galjoenweg 61 6222 NT. Soma Works makes employees available to clients and mediates freelancers. In that context, it is necessary for us to process (your) personal data.

As of 25 May 2018, the new Privacy Legislation is in force. After this date, Soma Works B.v. as data controller should 

In this privacy statement, we inform you about the use of your personal data. We recommend that you read this privacy statement carefully. Your personal data are handled and secured with the utmost care, in accordance with the requirements set by privacy laws and regulations.

Article 1 - Personal data we process

1. Soma Works processes personal data about you through the use of our services and/or because you provide it to us yourself. Below is an overview of the personal data we may process, depending on the purpose:

  • (Business) contact details
  • Phone number
  • Email address
  • Function
  • Date of birth
  • Gender
  • Copy of proof of identity
  • Data on training, education and tests you have attended yourself or through us 
  • CVs, information on training courses, internships and work experiences. 
  • Bank account number (IBAN) - Other personal data provided by or on behalf of you

The moment you start working for us, we are required to collect the following data as part of fulfilling the legal obligation: 

  • BSN
  • Copy of residence permit or work permit (if applicable)
  • Other data that can be linked to personnel, salary and absence records

All data is collected with the candidate's consent. 

Article 2 - At what point will data be collected? 

We collect your data from the moment you enter or leave your details on our website, register at our branch or otherwise sign up or are notified to use our services.

Article 3 - Purposes/bases of processing personal data

  • Personal data are processed by Soma Works only for the following purposes:
  • Intermediating staff with various clients; 
  • Setting up training programmes for candidates; 
  • Setting up a workforce; 
  • Making - on you personalised offers of services.
  • Being able to review you or your profile for availability and suitability for mediation.

Article 4 - Retention periods

We will retain your mediation data for one year after our last contact and/or approval of our legal basis. You will receive a notice six weeks before the expiry of the term in which we ask for your consent to any approval for renewal. If you wish to be unsubscribed in the interim, please let us know by sending an e-mail to info@somaworks.nl or by contacting the relevant Soma Works contact. 

Article 5 - Website

What are cookies?
Cookies provide information in the form of small text files when visiting a website. Cookies also occur on the Soma Works site. The cookies on the site of Soma Works B.v. are not harmful to the computer, but collect information about the user to provide insight into search behaviour. 

Transfer abroad
Among other things, Soma Works uses Google Analytics. Google's servers are located outside the European Union. Agreements have now been reached with the US to comply with minimum EU Privacy agreements.

Article 6 - Protection of personal data

Soma Works staff (as well as Soma Works as an organisation) are set up to prevent data breaches and incorrect data processing. Discrepancies and special cases are discussed during our regular Monday consultation meeting. A clean-up round is held on every Friday. The purpose the clean-up is to remove/anonymise data whose:

  • The candidate/contact person has requested removal; 
  • The candidate/contact person has made an objection for data inclusion;
  • Candidates who have not given approval on a (new) term; 

Article 7 - Third parties

1. Soma Works will not share any personal data of yours provided to Soma Works except (1) with your consent (2) as described in this privacy statement or (3) to authorised bodies. 
2. Soma Works engages third parties and/or processors to perform services, such as the management and security of its systems. Soma Works may provide personal data to these third parties and/or processors. Soma Works approves these parties only to use such data in connection with the services they perform.

Article 8 - Your rights

  • 1. You have the following rights under the applicable laws and regulations - and in accordance with the terms contained therein:
  • To request access to your personal data;
  • to obtain rectification of incorrect personal data; - to complete incomplete information;
  • in certain cases to have your personal data erased;
  • in certain cases to have your personal data "restricted";
  • in certain cases to object to the processing of your personal data;
  • in certain cases to obtain and transfer your personal data;
  • to file a complaint with a supervisory authority; We may have the right to refuse your request in certain cases. In that case, we will explain the refusal.
